Lindsay Clancy will return to court on Tuesday for a key hearing, as prosecutors weigh whether to retry the Massachusetts \u200bwoman on murder charges for killing her three young children in 2023 and her lawyers push for the case\u2019s dismissal.<\/strong><\/p>\n

Judge William \u200cSullivan in Plymouth, Massachusetts, scheduled the hearing after declaring a mistrial on September 4, which occurred after a single juror prevented the 12-member jury from reaching a unanimous verdict on whether to convict Clancy or find her not guilty by reason of insanity.<\/p>\n

Plymouth County District Attorney Timothy Cruz\u2019s office has in the \u200bweeks since been silent on whether it plans to retry Clancy on first-degree murder charges, which carry a life sentence. \u200bSullivan has said that he would ideally like any retrial to occur later this year.<\/p>\n

Clancy, 36, \u2060admits that she strangled her three children with exercise bands on January 24, 2023, in the basement of their home in the \u200bBoston suburb of Duxbury. She then cut herself with a knife and jumped from a second-story window in an attempt to end \u200bher own life, leaving her paralysed.<\/p>\n

Defence lawyer Kevin Reddington during her first trial sought to convince jurors that she did not understand what she was doing was wrong and that she had been in the throes of postpartum psychosis when she killed Cora, 5; Dawson, 3; and 8-month-old Callan.<\/p>\n

Several jurors have in televised interviews stated that but for the one holdout juror, they had been prepared to find her not guilty by reason \u200bof insanity, known in Massachusetts as lack of criminal responsibility.<\/p>\n

If found not guilty on those grounds, she would be committed to a state psychiatric hospital \u200cfor \u2060evaluation. Her commitment would then be subject to regular review by the court.<\/p>\n

Prosecutors have several options before them, including trying to reach a plea deal or retrying Clancy on lesser second-degree murder charges, which would give her the option to waive a jury trial and proceed before a judge.<\/p>\n

Clancy\u2019s lawyers have filed a series of motions seeking to head off the possibility of a retrial by urging Sullivan \u200bto declare her not guilty and \u200bbar a retrial on the \u2060grounds that there was no reason to declare a mistrial and that it would, as a result, violate her right to avoid being tried twice for the same crime, known as double jeopardy.<\/p>\n

They \u200bsay jurors had been clear in notes delivered to the judge that the holdout had been \u200brefusing to apply \u2060the court\u2019s instructions on how to determine if prosecutors proved their case beyond a reasonable doubt and that the juror should have been dismissed rather than allowing the case to be retried.<\/p>\n

Her attorneys have also asked Sullivan to allow them to review normally confidential records about \u2060the jury \u200band the holdout and question him about his truthfulness during the jury selection \u200bprocess and his cellphone use.<\/p>\n

The holdout\u2019s lawyer, Edward Paltzik, has criticised the defense\u2019s tactics.
