Court orders murder case against CTD officials over ‘fake’ encounter

A sessions court in Rawalpindi has ordered the registration of a murder and abduction case against officials of the newly formed Counter Terrorism Department (CTD) after declaring a police encounter in which a suspect was killed as fake.

According to case details, CTD personnel along with officials from Waris Khan police station arrested Naeem from his home on November 30. He was later reported killed in what police described as an encounter in an area far from Rawalpindi. Following court directions, Chakwal district police submitted a report stating they had no role in the encounter.

The victim’s sister, Asiya Bibi, submitted complete CCTV footage to the court, which was reviewed during the proceedings. The footage showed Naeem, also known as Guddu, being arrested alive from his home, with visible damage to property during the raid.

The court observed that the footage showed CTD inspectors Shafqat, Mohsin Shah and Sardar Alam, along with constables Malik Abid, Bilal Shah, Adnan and Ali Shah, entering the house with modern weapons, arresting the suspect and allegedly killing him about five hours later in a remote area of Chakwal.

Rawalpindi Additional District and Sessions Judge Sahibzada Naqeeb Shahzad ruled that the arrest from the victim’s home stood proven. He directed the station house officer of Waris Khan police station to formally record the victim’s statement and register a case accordingly.

The judge said no one has the right to arrest a citizen from their home and then kill them. He ordered that all police officers and personnel visible in the CCTV footage be booked in a murder case, noting that the footage also showed officers carrying dangerous weapons.

The petitioner’s lawyer, Faisal Mahmood Malik, warned that if police fail to register the case under abduction and murder provisions, he would file a contempt of court petition against the responsible officers.

The court observed that all suspects are entitled to a fair trial and that any punishment for crimes must be decided through due judicial process.
